L’objectif de cette étude est de comprendre l’influence de lois anticorruption canadienne et brésilienne dans les programmes de conformité au Brésil. Pour cela, la recherche sera divisée en trois parties, de sorte que la première partie analysera la corruption en soi, ses définitions, son histoire au Canada, au Brésil et au monde. Comprendre l’historique de son combat, des lois nationales, les principales Conventions adoptés au fil des années dans le but de diminuer les effets néfastes de la corruption nous aidera à avoir une meilleure idée du scenario actuel. Dans une seconde partie, on pourra connaitre mieux la corruption au Canada et au Brésil ainsi que les efforts de combat dans ses deux pays au fil des années par le survol sur l’histoire et des législations adoptées. Dans la dernière partie, on rentrera dans les programmes de conformité, pour mieux comprendre comme ce sujet a évolué au Brésil dans les dernières années, sous l’influence de ces deux lois nationales. La méthode de recherche déductive a été adoptée, dont les matériaux sont basés sur des doctrines, des articles et des lois existantes. La principale question à analyser est la suivante: comment les nouvelles lois anticorruptions brésilienne et canadienne ont changés les programmes de conformité au Brésil? S'agissant de la conformité, on peut dire qu'elle consiste en des politiques et procédures conçues pour détecter, combattre et corriger les irrégularités survenant dans la sphère de l'entreprise, généralement associées à des pratiques de corruption, visant à développer une culture de l’éthique, de l’intégrité et à prévenir les actes illicites. La corruption est une réalité partout dans le monde, mais ce n’est pas un fait récent, car l’histoire montre de nombreux cas de cette nature. Elle est un des principaux facteurs de distraction et générateur d’inégalité dans l’économie et, par conséquent, la conformité joue un rôle fondamental sur ce travail. The purpose of this study is to understand the influence of Canadian and Brazilian anti-corruption laws in compliance programs in Brazil. For that, the research will be divided into three parts. The first part will analyze the corruption itself, its definitions, its history in Canada, Brazil and in the world. Understanding the history of the fight against corruption, of the national laws, and the main conventions adopted over the years to reduce its harmful effects will help us get a better idea of the current scenario in Brazil. In a second part, we will better understand the corruption in Canada and Brazil, as well as efforts to combat it in those two countries over the years. This will be done through an overview of the history and the adopted legislations. In the last part, we will look into compliance programs to better understand how this subject has evolved in Brazil in recent years, under the influence of these two national laws. This work adopts the deductive research method, and analyzes existing doctrines, articles and laws. The main question is: how have the new Brazilian and Canadian anti-corruption laws changed compliance programs in Brazil? Compliance consists on policies and procedures designed to detect, combat and correct irregularities in the business sphere, generally associated with corrupt practices, developing a culture of ethics, integrity and preventing wrongdoing. It is one of the main distractors and generators of inequality in the economy, and therefore, compliance plays a fundamental role in this work.
