dcterms.abstractNotre mémoire s'intéresse aux effets de la norme interdisant le harcèlement psychologique dans trois grandes entreprises québécoises (Rio Tinto Alcan, Desjardins et Hydro-Québec). En fait, nous voulons évaluer les mesures mises en place par les entreprises pour contrer le harcèlement psychologique au travail et leur gestion de cette problématique. À titre complémentaire, notre étude analyse les effets normatifs des articles 81.18 à 81.20 de la Loi sur les normes du travail tels que les conçoivent le tribunal d'arbitrage et le Tribunal administratif du travail. Nous voulons donc observer l'évolution (avant vs. après l'apparition de la norme) et les différences dans l'interprétation de la norme traitant du harcèlement psychologique par les instances saisies. À cet effet, nous allons analyser la jurisprudence traitant du harcèlement psychologique au travail provenant des trois entreprises québécoises, depuis les années 1980 jusqu'à 2016. Notre recherche revêt un caractère exploratoire, le principal objectif étant d'appréhender l'effectivité normative. Par conséquent, seuls les effets normatifs seront pris en considération ; nous ne tentons pas de cerner ou d'expliquer les causes empiriques du phénomène. Bien qu'il faille se garder de conclusions hâtives, notre mémoire met en lumière la diversité des approches des entreprises face au phénomène du harcèlement psychologique au travail. Alors qu'Hydro-Québec se montre proactive en ce domaine avec l'adoption de politiques et de procédures internes détaillées pour lutter contre le harcèlement, ce qui est aussi le cas, mais dans une moindre mesure, chez Desjardins. La problématique semble totalement ignorée par Rio Tinto Alcan (en dépit d'un certain nombre de plaintes à ce sujet). Notre recherche constate par ailleurs certains écarts entre les arbitres de griefs et le Tribunal administratif du travail, notamment quant au taux de succès des plaintes. Enfin, on s'étonnera de l'absence de sentences arbitrales octroyant des dommages moraux ou punitifs, ce que permet la Loi sur les normes du travail, en dépit d'une conclusion favorable aux plaignants.fr
dcterms.abstractOur master's thesis is about the effects of the norm prohibiting the psychological harassment on three large enterprises (Rio Tinto Alcan, Desjardins and Hydro-Québec). We want to evaluate the measures implemented by companies to counter psychological harassment at work and their management of this problem. In addition, our study analyzes the normative effects of the articles 81.18 to 81.20 of the Act Respecting Labor Standard as conceived by the Tribunal administratif du travail and the arbitration tribunal. We want to observe the evolution (before vs. after the apparition of the norm) and the differences in the interpretation of the psychological harassment between the different courts of law. To this end, we will examine case laws treating of psychological harassment in the workplace, from the 1980s to 2016. The case law will come from the three Quebec enterprises. Our research is exploratory, the main objective being to apprehend the effectiveness of the law. Therefore, only the normative effects will be considered; we will not try to identify or explain the empirical causes of the phenomenon. Although do not want to make any hasty conclusions, our thesis highlights the diversity of the measures implemented by companies against psychological harassment at work. While Hydro-Québec is proactive in this area with the adoption of detailed internal policies and procedures to counter harassment, which is also the case, but to a lesser extent, with Desjardins. The problem seems to be totally ignored by Rio Tinto Alcan (despite a number of complaints about it). Our research also notes some gaps between the arbitration tribunals and the Tribunal administratif du travail, particularly regarding the success rate of the complaints. Finally, it is surprising that there are no arbitral awards according moral or punitive damages, which is permitted by the Act Respecting Labor Standards, despite concluding that the employee has been a victim of psychological harassment.fr
