Abstract(s)
Ce dossier est issu d’un atelier qui s’est tenu au Congrès de la Société québécoise de science politique en 2010, sous le titre « Les instruments juridiques dans le jeu politique ». Plusieurs contributions à cet atelier s’intéressaient non seulement aux instruments juridiques, mais également à l’impact des instruments managériaux sur le droit et le système judiciaire. Regroupés dans ce dossier, celles-ci proposent un regard comparatif sur le phénomène de la managérialisation du droit et de la justice qui est abordé sous de multiples angles dans la littérature. Après avoir présenté l’origine et l’utilisation du concept de la managérialisation en administration publique, cette présentation propose de structurer le débat autour de trois axes : la perspective sociologique de la managérialisation du droit, l’analyse en administration publique et en criminologie de la managérialisation du système judiciaire, et finalement, l’approche critique en droit public. Comme les résumés des quatre contributions qui concluent cette introduction le démontrent, les recherches regroupées ici visent surtout à contribuer aux deux premiers axes de recherche.
