Le droit au gré d’Internet : à propos d’une réseautisation fort peu anodine de l’univers juridique

Abstract

La création du droit, phénomène « mal connu » des sciences juridiques semble désormais entretenir une intimité problématique très forte avec le réseau Internet. Elle serait même au cœur du « grand bougé internétique » vers l’ère postmoderne. Ce nouvel espace juridique apparaît ainsi pour la création du droit un accélérateur réseautique, néanmoins respectueux du pluriel. Or, ce changement initié par Internet en entraîne un autre d’une ampleur tout aussi considérable : il force en effet les ordres juridiques à faire globalement évoluer leurs structures internes et les jette dans un univers où leur pertinence d’action est singulièrement réduite. Seul l’ordre juridique européen, en tant que première esquisse de l’Etat-réseau, y conserverait une certaine efficacité d’action faisant alors de lui un guide structurel à l’usage de ses congénères mis en difficulté.

The creation of right, phenomenon unknown of the legal sciences, should be now taken in the mouving towards postmodern era. The origin of this movement must be search in the Internet network. In this sense this new legal space is for the creation of right an « networking » accelerator, nevertheless respectful of the plural. But, this changing due to Internet cause another change that is as eminent : it oblige the legal institutions to develop globally their internal structure and pusch them in a universe where they can not have a relevant action. Only the legal order of europe, owing to his deep structure, should have a first-class place in this universe and be a help, but for that this order must trait their elements of modernity and protect his « genius ».
