Le conférencier jette un regard critique sur le mandat donné en prévision de l’inaptitude du mandant et formule l’hypothèse que cette institution ne protège pas adéquatement les personnes devenues inaptes, qui y ont pourtant massivement adhéré. Il propose des changements à la pratique contractuelle et à la loi
autour de six questions. Quelle est la nature de cette institution et quelles en sont les conséquences :
simple contrat ou régime de protection ? Faut-il exécuter ce mandat comme un acte unilatéral et secret ou plutôt
comme un véritable contrat bilatéral, avec le concours du mandataire et des obligations à sa charge ? Faut-il stipuler automatiquement les pouvoirs de la pleine administration ou
plutôt limiter les pouvoirs du mandataire à ceux qui sont nécessaires pour répondre aux besoins du mandant, tout en le mettant à l’abri des abus ? Faut-il donner carte blanche au mandataire ou plutôt l’obliger à faire inventaire
et à rendre compte périodiquement ? Le mandat doit-il être immuable ou plutôt susceptible d’être adapté aux
besoins du mandant, selon leur évolution ? Lorsque survient l’inaptitude, faut-il laisser le mandataire ordinaire agir indéfiniment avec une procuration générale en pleine administration ou plutôt l’obliger à faire homologuer avec diligence le mandat de protection, tout en limitant ses pouvoirs dans l’intervalle à ceux de la simple administration ?
