Hier considéré contraire à l’ordre public, aujourd’hui forme courante d’union conjugale, l’union de fait est acceptée dans la société québécoise et fait partie de ses moeurs. Si ce statut est socialement reconnu comme une alternative au mariage, le législateur n’en fait pas la même lecture et a une attitude pour
le moins ambiguë. En effet, tantôt il reconnaît aux conjoints de fait hétérosexuels, et depuis peu homosexuels, des droits et obligations identiques aux personnes mariées, alors que dans d’autres cas il ignore totalement cette situation de fait.
Cette dichotomie du droit ne peut que contribuer à créer une grande confusion et le fossé entre le droit commun et le droit statutaire s’élargit sans cesse. Ce vide juridique peut être comblé contractuellement ou à défaut par l’intervention judiciaire qui donne ouverture, de plus en plus, à la demande d’enrichissement injustifié. À la lumière de la jurisprudence récente, nous examinerons d’abord le traitement juridique des aspects patrimoniaux de l’union de fait en présence d’une convention de concubinage ou en l’absence de celle-ci. Puis, nous exposerons le contenu du droit statutaire québécois pour, par la suite, faire état des principales modifications proposées par le projet de loi fédérale en la matière.
