dcterms.abstract | Au XVe siècle, le mariage valide et légitime, selon les préceptes de l’Église, est monogame, consensuel, exogame et indissoluble. S’il est possible de décrire concrètement la théorie, que peut-on dire sur la réalité conjugale et la perception du mariage par les fidèles ? C’est à cette double question que ce mémoire tente de répondre. De l’Antiquité tardive à la fin du Moyen Âge, la doctrine du mariage évolue, se précise et finalement, se fixe inéluctablement. Dès lors, les unions qui ne correspondent pas à ces critères ne sont pas perçues comme licites par les autorités ecclésiastiques. Une relation non-maritale entraîne des conséquences dommageables sur la descendance du couple, dont la bâtardise. C’est à ce titre que la Pénitencerie apostolique intervient gracieusement en dispensant, en absolvant et en « aplanissant » la pratique des exigences du droit canon. Cet office adoucit ainsi l’application de la législation et permet à des couples, dont les mariages sont, en théorie, invalides, de demeurer mariés et de légitimer leurs enfants. | fr |
dcterms.abstract | In the fifteenth century, a valid and legitimate marriage, according to the Church, was monogamous, consensual, exogamous and indissoluble. If it is possible to describe rightly the theory, can we do the same about domestic reality and perception of marriage by the laity? It is to this double question that this master’s thesis seeks to answer. From late antiquity to the late middle Ages, the marriage’s doctrine changed, was refined and finally, fixed. Accordingly, the unions that do not meet these criteria weren’t perceived as legitimate by the ecclesiastical authorities. A non-marital relationship leads to noxious consequences for the couple’s offspring, whose illegitimacy. It’s why the Apostolic Penitentiary graciously intervened by exempting, by absolving and by "leveling" the canon law’s requirements. This office has softened the legislation’s implementation and allowed couples whose marriages were theoretically invalid, to remain married and legitimize their children. | fr |
