Abstract(s)
Dans cet article, je compare deux solutions apportées par Fichte au problème de l’instauration d’un ordre juridique juste. En effet, en l’espace d’un an, c’est-à-dire entre la Rechstlehre de 1812 et la Staatslehre de 1813, on note qu’il modifie de manière radicale sa position. Il passe en fait d’une solution pratique à une solution théorique. Si, en 1812, la personne la mieux habilitée à veiller à cette instauration est celle qui est douée de la « volonté » la plus juste, les difficultés intrinsèques à la mise en place de cette solution conduisent Fichte l’année suivante à privilégier la personne qui possède l’« entendement » le plus parfait et qui, grâce à sa connaissance exhaustive des circonstances concrètes au sein desquelles elle doit diriger, intervient de la manière la plus judicieuse et se trouve être de ce fait la mieux à même de faire reconnaître la légitimité de la contrainte légale. In this article, I compare tow solutions presented by Fichte to the implementation of a just legal order. In fact, in the space of one year, that is: between the Rechtslehre of 1812 and the Staatslehre of 1813, we observe a radical change in Fichte’s answer to this question. He replaces a practical solution with a theoretical one. If in 1812 the best suited person to proceed to this implementation is the one having the purest “will”, the impediments to the realization of this solution lead Fichte, the following year, to chose rather the person who has the most perfect “understanding” and who, thanks to his/her extensive knowledge of the concrete circumstances in which he/she has to exercise power, rules in the most appropriate manner and is therefore the right person to bring people to accept the legal constraint.
