Expériences institutionnelles et renonciation à la libération conditionnelle : récits de vie de personnes incarcérées et points de vue d’intervenants

Dans la province du Québec, chaque année, plus de 3 000 personnes détenues sont admissibles à une libération conditionnelle, au tiers de leur peine. La personne contrevenante y est ainsi convoquée d’office. En cas d’octroi par la Commission québécoise des libérations conditionnelle, elle purge alors le reste de sa peine dans la collectivité. Toutefois, le détenu peut également faire le choix de renoncer à cette mesure et rester en détention jusqu’au 2/3 de sa peine. Chaque année, plus de 1 000 personnes incarcérées font ce choix et renoncent à leur liberté au tiers de leur peine.
Objectif : L’objectif de cette étude est de s’intéresser aux circonstances qui amènent le détenu à renoncer à une libération conditionnelle à partir d’une analyse de ses expériences institutionnelles. Pour cela, une collecte de 3 sources de données a été réalisée : une entrevue sous la forme de récit de vie auprès de six détenus, la consultation de leur dossier carcéral et une entrevue semi-dirigée avec leur agent de probation.
Résultats : L’analyse des données recueillies fait ressortir qu’en dépit des éléments tels que le risque que représente la personne détenue, la participation de cette dernière à des programmes ou encore l’absence de problèmes dans la relation avec son agent de probation, ce sont davantage les perceptions des personnes contrevenantes à l’égard de la libération conditionnelle qui sont déterminantes. Les contrevenants indiquent que ces perceptions sont notamment nourries par les autres, dans leur quotidien en détention – par les codétenus et les agents – mais également par leurs proches. Ainsi, la manière dont les personnes incarcérées vont percevoir leur expérience carcérale, leur situation familiale, les conditions imposées dans le cadre d’une libération conditionnelle sont autant d’éléments qui permettent de comprendre la renonciation de ces individus à cette mesure de libération anticipée. In the province of Quebec, every year, more than 3 000 inmates are eligible for parole at
one-third of their sentence. The offender can make the request. If granted by the Quebec
Parole Board, she will serve the rest of her sentence in the community. However, the inmate
may also choose to waive this measure and remain in custody until 2/3 of his sentence. For
several years, more than 1,000 prisoners have made this choice and give up their freedom at
one-third of their sentence.
Objective: The purpose of this study was therefore to focus on the parole waiver
experiencies. To do this, it was to highlight the elements that, in the inmate's prison
experience, will lead him to give up.
Method: To achieve this goal, a collection of 3 sources of data was conducted: an interview
in the form of a life story with six inmates, the consultation of their prison records and a
semi-structured interview with their probation officer.
Results: The analysis of the collected data showed that despite the events experienced such
as "I represent a risk", "I have access and I participate in programs", "I have no problem with
my probation officer”, it’s the perceptions of delinquents about conditional release which
are decisive. Offenders indicate that these perceptions are particularly nourished by others,
in their everyday life in detention - by fellow inmates and officer - but also by their relatives.
Thus, the manner in which inmates will perceive their prison experience, their family
situation, the conditions imposed in the context of a conditional release are all elements that
allow to understand the renunciation of these individuals to this measure of early release.
