Abstract(s)
La protection des volontés du testateur,
tant formelle que substantielle,
constitue la mission essentielle
du tribunal. La recherche des intentions
véritables du testateur guide
le tribunal dans cette démarche.
Cette question est analysée ici sous
l’angle de l’interprétation judiciaire
des volontés du testateur et sous
celui de la discrétion judiciaire exercée,
tant à l’égard du formalisme
testamentaire qu’à celui du consentement
libre et éclairé du testateur.
À la suite de la présentation des
principes usuels d’interprétation des
testaments, le présent texte traite,dans un premier temps, de la protection
de l’intention du testateur par
les exigences de forme du testament.
À cette fin, sont examinés la validité
des documents préparatoires et des
notes manuscrites, dactylographiées
ou informatisées, ainsi que le pouvoir
du tribunal de régulariser certains
défauts de forme.
Le second volet de la protection
de l’intention du testateur s’exprime
par la recherche du consentement
libre et éclairé de celui-ci. De cette
protection découle la sauvegarde, si
possible, du testament. Dans cette
optique, on y souligne l’importance
des présomptions légales (la présomption
légale de capacité en dehors
de tout régime de protection et la
présomption variée d’incapacité sous
un quelconque régime de protection)
et la perspective dans laquelle les
charges et les conditions d’un testament
peuvent être révisées par le
tribunal.
